Minutes from the HOA meeting on Sunday,
October 16, 2005
A
total of 39 homes were represented at the meeting (4 by Proxy).
President,
Allen Devoll, called the meeting to order at 2:30 pm.

The
HOA Board's Mission Statement was read by Allen Devoll.
Discussion
of Agenda Items:
7th
Amendment - Allen Devoll explained the reason for proposing
the 7th Amendment and opened the floor to discussion. There were
questions regarding the number of homes for rent/lease in the community,
and also discussion regarding whether or not there were as many
non-rental homes in the community that are not up to ACC standards.
Later in the meeting a vote was taken to decide whether or not to
move forward towards putting the 7th Amendment to a vote. The majority
of attendees were against the 7th Amendment so it will not be pursued.
ACC
Violations - Violation letters went out in September and early
October. Despite the fact that apology notices went out via email
and again in the September newsletter, several people complained
about letters being taped to mailboxes vs. mailed, and about some
incorrect violations noted in some letters. This issue was discussed
in depth. There was debate that the notices were too formal and
impersonal, yet the method for delivery was not formal enough. An
overwhelming majority of homeowners would like to see the violation
notices mailed if the budget can afford it. In the end it was decided
that the initial notice would be hand delivered and all subsequent
fine notices would be mailed. The ACC Committee, like all offices/positions,
is made up of volunteers and they do their best to only note true
violations. They are human and they will make mistakes. They are
also lacking much-needed volunteers to help with drive-thrus (or
walk-thrus) of the community and with compiling/mailing the violation
notices. Despite the confusion surrounding the letters, there were
considerable improvements made on most of the properties cited.
It was reiterated that if people feel that a violation has been
noted in error they may contact the ACC and ask for clarification.
People are also free to request an extension if they need more time
to remedy a problem with their property. Some people complained
that the ACC has only provided an email address for communication
with the committee. Denise Ryan provided a phone# that has been
set up by Alex Iglesias primarily for ACC business. The # is 770-573-1407.
The ACC is currently trying to find out which homes are bank-owned
and get real-estate agent contact information for homes that are
for sale.
Social
Committee - Debra Devoll spoke about plans to have more events
in 2006 due to the increased budget for the Social Committee. There
are plans to have a holiday lighting contest in December. More details
will be coming out in November.
Old
Business -
In 2006, there will be a No Smoking policy for the pool area due
to problems with cigarette butts being thrown on the pavilion floor,
in the pool and in the grass areas around the pool.
Another
request was made for volunteers for Committees and also some HOA-related
improvement tasks.
We
are still having problems with ATVs being ridden within the subdivision
and in the common areas by the pool and tennis courts. Warrants
will be filed for repeat offenders.
Unfinished
Business - Reviewed proposed improvements for 2006. Allen Devoll
discussed the pavilion floor resurfacing project. He has received
two bids thus far, both over $12K. The HOA Board feels that this
is an improvement we can do ourselves with volunteers from the neighborhood,
at a savings of up to $8K. Anyone who is interested in helping should
contact Allen via email or phone.
At
the last HOA Meeting, several homeowners expressed an interest in
having lighting installed around the tennis courts and in the parking
lot. At this meeting, the general consensus was that lights at the
tennis courts are not needed or desired because of the lack of use
of the courts. The HOA Board, however, will still continue to pursue
installing lights for the parking lot, walking path, play area and
basketball courts.
New
Business -
7th
Amendment - Major discussion had already taken place earlier
in the meeting so all that occured during this part of the meeting
was a vote on whether to pursue the Amendment. The majority of those
present voted "NO" to pursuing the Amendment.
2006
Budget - The budget was reviewed and the floor opened to
questions. There were a few questions but not major issues related
to the budget. The Financial Report as of the end of September was
passed around the meeting. Several homeowners requested copies,
and Heidi Jansen agreed to get an electronic version from the Accountant
and post online for homeowners to view and print their own copy.
Peter Hawkins suggested implementing a more formal bid process and
communicating a bid period via our website, Newsletter, paulding.com
and local newspapers.
Speed
Bumps - Speeding is still an issue on Brooks Road. The DOT
will not put speed bumps on the street since it is considered a
"county road." They have suggested that we take the tag
numbers of those who speed and report them to the Sheriff Dept.
Allen Devoll gave out the number to the DOT representitive responsible
for our area. His name is Scott Hutchins and can be reached at 770-445-4759.
We should call him to ask any questions or to complain.
Pavilion
Roof Leak and Bathroom Repairs - These repairs will need
to be made soon. Allen Devoll asked if there were any contractors
in the neighborhood who could do the repairs or assist with the
repairs.
Pets
- Heidi Jansen reported that there have been several complaints
made to the HOA in the past month regarding pets being allowed to
roam the neighborhood without the owner's control. There has also
been one complaint of excessive barking. Although there are no HOA
controlled Covenants regarding control of pets, there are County
Ordinances that should be followed. Heidi Jansen brought a copy

Floor
opened to questions -
Shannon
Cook asked if anyone knew of a general contractor or painter in
the neighborhood.
A
homeowner suggested having "No Soliciting" signs posted
at all entrances to the subdivision to keep unwanted solicitors
from knocking on doors and putting flyers on our mailboxes and in
our yards.
Someone
suggested adding a note about asking ACC for an extension to fix
violations to the next Newsletter.
Chat
Room should be put together to provide another vehicle for homeowners
to communicate. Another homeowner, Debbie Brooks, had suggested
this previously to Heidi Jansen. Trying to locate a free service.
Peter
Hawkins suggested instituting formal Roberts Rules to help maintain
control of the meeting and prevent it from going to long.
